How to appeal the decision of the military medical commission on fitness for service

The military medical commission evaluates the state of health and decides whether a person can serve in the army after receiving a summons. If you disagree with the conclusion of the Military Medical Commission (MMC), you can appeal it. How to do it was explained in “Free legal aid”. This can be done in a pre-trial or judicial procedure. For example: if the conclusion was submitted to the VLK of the district (city) territorial center, then it is necessary to contact the VLK of the region or the city of Kyiv; VLK of the regions – contact the VLK of the regions; resolutions of any VLK may be reviewed by the Central VLK. In order to file a complaint, you must have the following documents: an application for review of the contested resolution of the lower-level VLC, in which the reasons for the review of the resolution are indicated; all available documents were issued by the VLK, whose decision is under review; results of previous medical examinations (if any). If the appeal takes place in a pre-trial procedure, a higher-level commission may order a repeat or control medical examination. In the case of a judicial appeal, it is possible to apply to the court immediately, without prior use of the pre-trial procedure or after receiving a negative conclusion after the pre-trial procedure. The appeal of the conclusion of the VLK in the court procedure will be given: 3 months – if the pre-trial procedure was first applied. The countdown starts from the day of delivery of the decision regarding the consideration of the appeal of the resolution; 6 months from the date of issuing the relevant resolution of the VLK.
