The Federal Court rejected Rosneft’s claim for the transfer of its subsidiaries to state management

The Federal Administrative Court of Germany dismissed Rosneft’s claim against the country’s government. The Russian state corporation tried to challenge the introduction of external management by its two German “daughters”.

In September, Rosneft Deutschland and RN Refining & Marketing were placed under state control and transferred to the balance sheet of the Federal Network Agency of Germany.

The companies owned a controlling stake in the important for Germany oil refining plant PCK, located in Schwedt in the east of the country.

The plant, which produces 12 percent of all petroleum products produced in the Federal Republic of Germany, supplies gasoline and diesel to the cities of eastern Germany, including the capital Berlin. The guardianship was appointed in view of the imminent danger of the cessation of oil supplies as a result of the full-scale war that Russia started in Ukraine.

The court in Leipzig spent four days considering Rosneft’s lawsuit and heard the testimony of numerous witnesses about the state of affairs within the subsidiaries of the Russian concern in 2022.

The Ministry of Economy of the Federal Republic of Germany based its decision on the fact that German subsidiaries of Rosneft could face intractable problems due to EU sanctions against Russia. Banks and insurance companies could stop cooperating with them. Enterprises were threatened with bankruptcy.

External management at the oil refinery was supposed to end on March 15. But the withdrawal of Rosneft’s claim will be extended.
