The son of the deceased serviceman of the Ukrainian Armed Forces asks the court to deprive his grandmother of guardianship over him. The boy claims that she does not take part in his life and uses the status of a guardian to receive funds intended for him as the son of a deceased military woman.

The child lives abroad with his stepfather, who is his guardian abroad, and his sister’s father.

After the death of the mother while performing a combat mission, the child’s grandmother appealed to the Ukrainian state authorities and received a decision to deprive the biological father of parental rights and to appoint herself as guardian. However, the boy himself claims that his grandmother does not fulfill his guardianship duties and does not live with him.

The boy reported that his grandmother does not take part in his life and misleads the state authorities, using her guardianship to receive the funds assigned to him as the son of a deceased military servicewoman.

He reported that the Ministry of Defense of Ukraine assigned him a one-time aid, but these funds ended up with his grandmother, and their further fate is unknown to the child.

To date, the woman has received 1.375 million hryvnias in payments as a guardian. The investigation has the facts of the withdrawal of funds, but there is no information about their use. Investigators confirmed that the woman did not purchase any real estate with these funds, and no evidence of their use has been discovered so far“, said in the comment “UP. Life” head of the communication sector of the National Police Department of the Ivano-Frankivsk Region Andriy Yatskiv.

Children’s Services conducted an investigation and confirmed that the grandmother was not fulfilling her duties as a guardian.

Currently, in the Ivano-Frankivsk region, a court proceeding is underway regarding the release of the grandmother from the duties of guardian. The Ivano-Frankivsk police reported that the woman is currently at large. In the summer, her accounts were seized – since then she has not received payments.

According to Yatskiv, before the accounts were blocked, the woman did not manage to receive all the funds, but only a part of them.

The funds intended for the child are currently blocked and their future fate will be decided after the court decisionYatskiv noted.

Based on the boy’s statement, criminal proceedings were initiated under part 5 of Article 190 of the Criminal Code of Ukraine.

Part 5 of Article 190 deals with fraud committed on a particularly large scale or by an organized group. When all the witnesses will be questioned, in particular from Italy (where the boy currently lives – ed.) and the necessary facts will be collected, the woman’s actions will be given a final legal qualification. The sanction of the article provides for deprivation of liberty for a term of 5 to 12 years with confiscation of property“, the police explained.

The Ombudsman of Ukraine represents the interests of the minor in court, since the child is abroad and cannot independently defend his rights.

This particular case is the first and currently the only one when, as the Ombudsman of Ukraine, I represent the interests of a minor child who is abroad in court and cannot independently exercise his rights.

The goal is one – to ensure access to justice for the child and restoration of his violated rights“, Lubinets noted.
