The State Duma approved the release of those accused of participating in the war in Ukraine
The State Duma immediately adopted in the second and third readings a draft law that would allow the conclusion of military service contracts with the accused at the stage of court proceedings.
In addition, the State Duma adopted a bill that would allow defendants called up for military service by mobilization or contract to be released from criminal liability. During the period of military service, the proceedings in criminal cases will be suspended, and the restraining order will be canceled.
Defendants will be able to be fully released from criminal liability after receiving a state award or dismissal from military service (due to age, health, due to the end of the period of mobilization, cancellation of martial law or expiration of military service).
The current legislation does not allow concluding a military contract with the accused, if their case is in court. Now, those who are under investigation, but their cases have not yet been brought to court, or those who have already been convicted, have the opportunity to release themselves from responsibility after signing a contract and going to war.
