The Russian company “Ultra” plans to sue the trademark Xiaomi, which belongs to the Chinese corporation of the same name. “Kommersant” learned about it.

According to the lawsuit, LLC “Ultra” (UltraTrade) intends to cancel the legal protection of the Xiaomi brand due to its “non-use” in Russia. The specific types of goods in which the Russian company wants to judge its name are not specified.

“In which categories will we prove interest, and the right holder does not prove the fact of using the trademark, then the protection will be revoked,” said the representative of “Ultra”.

At the same time, “Ultra” already sells electronics of brands – both related to Xiaomi and not – under the guise of equipment directly from Xiaomi, “Kommersant” found out.

Lawyers believe that “Ultra” wants to sell its goods under the designation of a popular brand in Russia, or to obtain the import of original products by “parallel import”, that is, without the official permission of the copyright holder.

In Russia, Xiaomi is among the top 5 in terms of sales in almost all categories of smart home products, Kommersant writes. After the full-scale invasion of Russia into Ukraine, the brand did not publicly leave the Russian market, however, from March 2022, its devices will be imported into the country by third-party suppliers.
