The Cabinet of Ministers announced a new procedure for the reservation of conscripts, which provides for a postponement of mobilization for 50% or more of civil servants and employees of enterprises important to the country.

Details: Reserve conscripts are granted a deferment from conscription for military service during mobilization. It cannot exceed:

  1. period of mobilization – for conscripts who work in state authorities, other state bodies, local self-government bodies;
  2. six months – for conscripts who work:
  • at enterprises, institutions and organizations that have been assigned mobilization tasks (orders);
  • at enterprises, institutions and organizations that produce goods, perform work and provide services necessary to meet the needs of the Armed Forces and other military formations;
  • at enterprises, institutions and organizations that are critically important for the functioning of the economy and ensuring the livelihood of the population in a special period.

The heads of state authorities, other state bodies, local self-government bodies, enterprises, institutions and organizations are responsible for the inclusion of conscripted workers in the lists, as well as for the correspondence of the registration data of conscripts specified in the list with their military accounting documents.

IN state authoritiesother state bodies, state administration bodies, the jurisdiction of which extends to the entire territory of Ukraine, the number of conscripts who are subject to reservation and occupying positions should be 50% of the number of conscripts – with the exception of the management level.

The following are subject to reservation, regardless of military rank, age, and military accounting specialty: conscripts holding public service positions of categories “A” and “B”, heads of ministries and their deputies, heads of state bodies, state administration bodies whose jurisdiction extends to the entire territory of Ukraine, and their deputies, heads of independent structural subdivisions of such bodies and their deputies, as well as employees of patronage services.

IN local self-government bodies conscripts, who occupy positions of 1-4 categories of positions, are subject to reservation regardless of rank, age and specialty. Among officials of 5-7 categories, reservation is possible for 50% of conscripts.

Enterprises, institutions and organizations that have been assigned mobilization tasks (order), must also reserve 50% of their conscripted employees. In the case of justified need, the number of reserved persons may exceed 50%.

Conscripted managers and their deputies in such enterprises, institutions or organizations, as well as employees of enterprises, institutions and organizations of the fuel and energy complex, the list of which is approved by the Ministry of Energy, are subject to reservation regardless of military rank, age and military accounting specialty.

There is no limit on the number of conscripts subject to reservation to PEK enterprises.

Enterprises, institutions and organizationswhich carry out the production of goods, the performance of works and the provision of services necessary for provisionneeds of the Armed Forces and other military formationsmust reserve 50% of the number of conscripts, and in case of justified need – and more.

The heads of these enterprises, their deputies, as well as employees of PEK enterprises, the list of which is approved by the Ministry of Energy, are subject to reservation regardless of military rank, age, and military accounting specialty.

Enterprises, institutions and organizations that are critically important for the functioning of the economy and ensuring the livelihood of the population in a special period, must reserve 50% of conscripted workers, but can be more.

Managers and deputy managers of such enterprises, employees of the PEK sector, as well as employees of specialized UN agencies, foreign diplomatic agencies, representative offices of donor agencies, executors of international technical assistance projects, representative offices of international organizations, international and Ukrainian non-governmental organizations implementing humanitarian projects must be booked. with the funds of international partners, which are critically important for the functioning of the economy and ensuring the livelihood of the population in a special period.

The lists are submitted to the relevant authorities and approved by the General Staff of the Armed Forces (SBU, Foreign Intelligence Service), and they send them to the Ministry of Economy, which issues the final reservation documents.

Reservations already provided to the employee according to the old procedurewill be valid for the period for which they were provided.

In the case of loss of grounds for booking (completion of the mobilization task, dismissal, disbandment of a state body, etc.) the postponement is cancelled.
