At the request of the relatives, the Mytyshchyna City Court terminated the posthumous criminal prosecution of the nationalist Maksym Martsinkevich, nicknamed Tesak. This is reported by Kommersant.

According to the newspaper, the petition to terminate the criminal prosecution in connection with the death of the accused was submitted by Marcinkevich’s father. According to the law, such wording is a non-rehabilitating circumstance. Previously, Tesak’s relatives refused such an option, despite repeated offers from the investigation.

As lawyer Aleksey Mikhalchyk said, his trustees “lost interest in the process” after the court at the end of 2022 rejected the relatives’ request that the case against Martsinkevich be considered posthumously with the participation of a jury. The family wanted to “find out in court the circumstances of the death of Maksym Martsinkevich, but when the trial was conducted by one judge, this was completely excluded,” explained the defense attorney.

The victims also did not object to the termination of the prosecution, the lawyer added.

36-year-old Maksym Martsinkevich was one of the most well-known Russian far-right activists to the general public. He spent almost ten years in the colonies for violations of extremist legislation and hooliganism with the use of violence. On September 16, 2020, he was found dead in a detention center in the Chelyabinsk region, where he was awaiting transfer to Moscow for interrogation.

According to the version of the Investigative Committee, Tesak committed suicide, first cutting his veins, and then hanging himself. As the reason for the suicide, the SC cited Tesak’s confession “in a confidential conversation with the investigator” in the murders on ethnic grounds, committed by him in the mid-2000s. Martsinkevich was threatened with a life sentence.

Tesak’s relatives believe that he was killed, and that he gave his confessional testimony under torture, the traces of which on the body of the deceased were confirmed by an independent examination.

After Martsinkevich’s death, it became known that he left three suicide notes, but they contradict each other. In one of the notes, the nationalist actually admits that he participated in the murders, in the other he reported that he had blackmailed himself and his associates. The authenticity of the notes has not been officially confirmed.

According to “Kommersant”, Martsynkiewicz issued nine guilty pleas.

In December 2020, six alleged associates of Tesak, suspected of a series of murders based on the nationalist’s testimony, were detained. Martsinkevich was a witness in this case, and then became an accused.
