According to the court’s decision, the shares of one of the largest gas production companies of Ukraine, “Ukrnaftoburinnia”, were transferred to the management of ARMA.

The decision refers to the decision of the Pechersk District Court of Kyiv dated April 11, by which the shares of “Ukrnaftoburinnia” are transferred to the National Agency for Identification, Search and Asset Management. The shares were seized on April 7.
According to the data register, “Ukrnaftoburinnia” is owned by ARES SYSTEMS LTD. (22.49%), DERIPON COMMERCIAL (22.49%), LTD, JKX Ukraine BV (10%) and ARIANA BUSINESS LIMITED (22.49%). The company is associated with businessmen Igor Kolomoiskyi, Pavel Fuchs and Vitaly Khomutynnik.
“Ukrnaftoburinnia” is one of the largest gas production companies of Ukraine: in 2021 gas production reached 725.4 million cubic meters.
The criminal proceedings, within which the shares were seized, relate to the industrial development of the largest explored Sakhalin gas field in Ukraine in the Kharkiv region.
According to the investigation, officials of Nadra Ukrainy NJSC, the State Geology and Subsoil Service of Ukraine, Sakhalinske LLC, Ukrnaftoburinnia LLC, Sirius-1 LLC, Devon CJSC, and East Europe Petroleum LLC (formerly LLC ” Golden Derrick”) committed abuse of office by prior conspiracy.
Thus, the distribution of profits from joint activities depended on the operators: “Sakhalinske” LLC, “Sirius-1” LLC and “Devon” CJSC.
“Nadra Ukrainy” company, in violation of the Cabinet resolution, alienated the shares belonging to it in the joint partial property, and “Golden Derrick” LLC withdrew from the group of participants and made appropriate changes to the agreements on joint activities.
The latter was once a partially state-owned company as part of Nadra Ukrainy JSC. In 2011, the company received more than two dozen special permits for subsoil use on a non-competitive basis.
In 2013, “Golden Derrick” became the successor of all the rights and obligations that belonged to NJSC “Nadra of Ukraine” and the subsidiary “Poltavnaftogazgeologiya” in the development of the Sakhalin oil and gas condensate field.
Therefore, “Ukrnaftoburinnia” was included in the joint activity due to the presence of a special permit for the use of subsoil. At the same time, as the Supreme Court established, the issuance of a special permit was illegal.

According to the investigation, due to the illegal activities of the officials of PJSC “Nadra of Ukraine” and a number of commercial structures, Ukraine actually lost the right to the Sakhalin oil and gas field in the Kharkiv Region.
