The draft law on the legalization of porn was registered in the Council

The bill, which proposes to decriminalize pornography, was registered in the Verkhovna Rada.

This is stated on the page of the draft law No. 9623 on the VRU website.

Currently, the accompanying documents to the draft law (explanatory note, text of the draft law) have not been published.

As the EP previously wrote, the draft law proposes to review the effect of two articles of the Criminal Code: Article 301, which deals with the import, production and distribution of pornography, and Article 302, which deals with the organization of “places of debauchery”.

Article 301 are proposed to be presented in a new version, which will provide punishment only for the distribution of pornographic content without the consent of the person depicted in it, or for the distribution of pornography among minors.

For the distribution of pornography without the consent of the person depicted in it, it is proposed to provide for a fine of 17-51 thousand UAH, arrest for up to six months or restriction of freedom for a period of up to three years. For the sale of pornography to minors, as well as coercion to create porn – a fine of UAH 85,000-170,000 or imprisonment for three to seven years.

In addition, the authors of the project propose to introduce the concept of “extreme pornography”, i.e. images of violent acts, sexual acts with animals or the body of a dead person. The production and distribution of such materials is proposed to be punished with fines in the amount of UAH 51,000-85,000, restriction of liberty for a period of three to five years, or imprisonment for a term of up to three years.

The authors also define the concept of “pornography” in this article. These are materials that depict a person “in a real or simulated overtly sexual image or engaged in real or simulated overtly sexual behavior or any depiction of genitalia for sexual purposes.”

Article 302 suggest to exclude altogether. Despite the cancellation of this article in the Criminal Code, the authors of the document say, the responsibility for creating and maintaining brothels related to human trafficking, pimping or involvement in prostitution will remain. These actions are punishable by Articles 149 and 303, respectively.

Also, the authors of the draft law emphasize that the changes will in no way concern the distribution or production of child pornography.
