The Individual Deposit Guarantee Fund plans to give the main office of Ibox Bank in the center of Kyiv to the Ministry of Defense for the needs of the military. This was reported to UBR.ua by a source in the FGVFL.

In confirmation of such plans, the interlocutor provided a letter from representatives of the Ministry of Defense, addressed to the liquidator of the fund Andrey Fedorchenko, who manages Ibox Bank after the NBU board made a decision to liquidate the bank.

In letter No. 1313 dated April 27, addressed to Fedorchenko, it is reported that the main office of Ibox Bank is needed for one of the military units.

Taking into account the decree of the President of Ukraine dated February 24, 2022 No. 64/2022 “On the introduction of martial law in Ukraine”, in order to ensure the combat capability of the military unit A4742, the organization of proper conditions for service, as well as the creation of prerequisites for the successful completion of the combat tasks facing the unit , we are contacting you with a request to temporarily provide free-of-charge premises at the address of Kyiv, […]not used for the period of wartime, for […]”, says the letter signed by the chief of staff, the deputy commander of military unit A4742, Alexander Satdinov.

It follows from the document that the department does not plan to buy this property of the bank, but wants to receive it free of charge for the period of the war and spends the funds only on communal services.

“Desirable period of use: for the period of martial law and three months after its termination (cancellation). At the same time, we undertake to conclude an appropriate agreement on the reimbursement of utility costs (electricity, water/drainage, heat/heating, removal of household waste),” the letter of the deputy commander of the military unit states.

According to the source, the in-principle consent of the liquidator and the Guarantee Fund to this appeal was received even before writing this letter on behalf of the military unit, and the letter itself is a necessary formality.

The densely populated center of Kyiv

The main office of Ibox Bank is located in the center of Kyiv. This is a crowded area of ​​the city, residential apartment buildings are located nearby, and it is quite difficult to hide the work of the military from unnecessary eyes in this place.

“Consent has been received, the matter is about formalities. But the premises is located on a densely populated street, there is no corresponding own fenced territory where roadblocks could be placed and disguised… This, obviously, can be used by hostile informants and will become a target of the DRG for launching rocket attacks on this object or carrying out sabotage. This will clearly threaten the lives of civilians in this area, as well as the lives of the servicemen themselves,” the source said.

The guarantee fund violates the law

In addition, there are legal violations. Lawyers note that the Fund has no right to transfer this house for use by anyone, since it is someone else’s property.

This contradicts the task of the Fund to effectively liquidate the bank and use the property. Such a thing, even in the conditions of martial law, is actually a violation, in my opinion, of the very tasks set before the Fund and formally in connection with such actions by shareholders and other affected persons. from the liquidation of the bank, which may be put forward to the Fund in the future, precisely about the demand for compensation for the damage already caused by the Fund for the improper disposal of the property,” commented Rostyslav Kravets, senior partner of Kravets and Partners JSC.

According to him, the Guarantee Fund could have done so if it had bought the property from the bank and handed it over to the Ministry of Defense, or the Ministry would have bought it at its own expense. But the proposed Ministry of Defense does not provide such an option.

Earlier, the Ministry of Finance wrote that on March 7, 2023, the NBU board decided to revoke the banking license of Ibox Bank and liquidate it.

On March 8, the Security Service of Ukraine and the Bureau of Economic Security conducted searches in the offices and branches of Iboks Bank, which is suspected of assisting the gaming business in tax evasion in the amount of UAH 400 million.

The Ministry of Finance also announced that the Guarantee Fund began paying guaranteed sums to depositors of Ibox Bank from March 24, 2023.
