One of the largest Ukrainian stevedoring companies, TIS, plans to go to court over the Ministry of Infrastructure’s cancellation of regulations regarding private companies’ receipt of a portion of ship dues in the “Pivdenny” port.
This is stated in the statement companies TIS
The company appeals to the fact that, as one of the largest participants in the maritime freight industry, and at the same time, “once again we receive extremely important information that directly affects thousands of our employees, not from a transparent dialogue with the state, not within the framework of consultations, but from social networks of the law enforcement agency”.
“This, among other things, gives us reason to consider the justification about the lack of funds in AMPU as fictitious, and the decision of MIU dictated not by the interests of the industry, but by the pressure of law enforcement officers,” TIS said.
It is about message The National Anti-corruption Bureau, from which it became known about the cancellation of the norm that allowed private companies to receive half of the shipping fees in the “Southern” seaport. This rule has been in effect since 2015.
Yes, in mid-April by order No. 148 the ministry amended the order #281, which determined that the Administration of Seaports of Ukraine (AMPU) will once again receive all 100% of shipping fees in the port, in particular – the “Southern” port. The ministry explained this decision by the lack of funding for the AMPU during the war.
Just by order #281 on July 24, 2015, NABU filed a charge against ex-Minister of Infrastructure Andrii Pyvovarskyi on charges of causing losses to the AMPU in the period from 2015 to 2021 of more than 43 million dollars.
“We consider this decision (order No. 148) illegal, and we intend to challenge it in court in the near future,” TIS said.
The company claims that a portion of the ship’s toll it has been receiving since 2015 has been accumulating in a trust account to keep the depths operational and safe.
“We intend to go to court to challenge the dangerous decision, which will close any opportunities for attracting foreign investors to Ukraine for many years. The investment climate is collapsing much faster than NABU’s reputation, and it takes decades to rebuild,” TIS said.
We remind you:
Ministry of Development of Communities, Territories and Infrastructure canceled the norm that allowed private companies to receive half of the shipping charges in the “Southern” seaport.
On February 22, 2023, NABU and SAP informed Pyvovarsky about the suspicion of abuse of official position, which allegedly caused losses to the state in the amount of more than 30 million dollars in 2015.
In March, a bail of UAH 10 million was made for Pivovarskyi.
Pivovarskyi held the post of Minister of Infrastructure in the government of Arseniy Yatsenyuk from December 2014 to April 2016.
