VAKS allowed to start an absentee investigation against Bakhmatyuk

The higher anti-corruption court allowed a special investigation into the owner of the agricultural holding “Ukrlandfarming” Oleg Bakhmatyuk in the case of a bribe to ex-head of the Federal Security Service Roman Nasirov and his adviser.

The decision of VAKS was issued on March 31. The court granted permission to carry out a special pre-trial investigation (in absentia) regarding Bakhmatyuk.
According to the investigation, during 2015-2016, the head of the State Fiscal Service, Roman Nasirov, received more than UAH 722 million in bribes from Bakhmatyuk for providing VAT refunds to companies controlled by Bakhmatyuk in the amount of more than UAH 3.2 billion.
It is noted that the decision on a special pre-trial investigation will allow the pre-trial investigation of the suspect to be completed and the case to be referred to the State Criminal Court for review on the merits.
The actions of the owner of the agricultural holding are qualified under Part 4 of Art. 369 of the Criminal Code of Ukraine, the former head of the SFS of Ukraine – according to Part 4 of Art. 368 of the Criminal Code of Ukraine, and his adviser – under Part 5 of Art. 27, Part 4 of Art. 368 of the Criminal Code of Ukraine.

In October 2022, Nasirov, his adviser, as well as the owner of Ukrlandfarming Oleg Bakhmatyuk reported the suspicion in the VAT refund case.
Nasirova was chosen as a preventive measure custody until December 17 with the alternative of depositing a deposit in the amount of UAH 523.2 million.
Subsequently, it was reported that the appeal of the High Anti-Corruption Court left unchanged preventive measure in the form of detention and UAH 523.2 million bail for the former head of the State Fiscal Service Roman Nasirov.
