The Penza district court satisfied the claim of local resident Maksym Moiseyev for compensation for moral damages for illegal criminal prosecution. They tried to mobilize Moyseev for the war in Ukraine, but he refused to accept the summons. A criminal case was initiated against him, but Moiseyev filed a counterclaim, and his prosecution was declared illegal.

As the publication “7×7 – Horizontal Russia” clarifies, Moiseev refused to mobilize at the end of September last year. After that, he was detained and spent two days in a detention center. The Investigative Committee opened a criminal case under the article on evasion of military service.

Moiseev turned to the prosecutor’s office. At the beginning of October, the regional prosecutor’s office recognized the initiation of a criminal case as illegal. The head of the regional department of the investigative committee suffered disciplinary responsibility because of this. Moiseyev received the right to rehabilitation, including compensation for the 48-hour detention, for illegally initiating a criminal case.

Moiseyev estimated the moral damage caused to him at 300 thousand rubles. However, the court awarded him significantly less compensation – 20 thousand rubles.

The “Military Lawyers” Telegram channel reports that Moiseyev’s case was the first and, at the moment, the last time a criminal case was initiated for evasion of mobilization. According to Russian law, refusal to sign a subpoena is an administrative offense and is punishable by a fine.
