The draft law introduces amendments to the Tax Code of Ukraine and a number of laws that provide for the repeal of certain norms of legislative acts introduced for the period before the termination or abolition of martial law on the territory of Ukraine from July 1, 2023. In particular:

  • the possibility for FLPs and legal entities to be payers of the uniform tax of group III with the application of a rate of 2% of the amount of income is canceled;
  • the possibility for FLPs – single tax payers of groups I and II not to pay a single tax is cancelled;
  • document checks are resumed;
  • the course of time determined by the tax legislation is restored;
  • fines for violation of tax legislation are renewed;
  • penal sanctions for violation of the correctness of accrual, calculation and payment of a single contribution to the mandatory state social insurance are renewed;
  • Penalties for violation of the procedure for using the PRO/PRRO are renewed.

These are steps in the fiscal policy that the Ukrainian authorities are obliged to implement within the framework of the Memorandum on Economic and Financial Policy dated December 8, 2022 and the implementation of measures, the implementation of which will contribute to an increase in tax revenues in 2023, Yuzhanina noted.

At a meeting on January 27, the Cabinet of Ministers approved a bill providing for the abolition of the preferential taxation system for small businesses, which allows paying only 2% of income, from July 1.

On March 15, the Verkhovna Rada adopted Law No. 7137-d, which introduced 40 new regulations for business during martial law. In particular, he allowed companies with a turnover of up to UAH 10 billion to switch to a simplified taxation system, as in the third group of FOP. Instead of VAT (20%) and profit tax (18%), they will pay 2% of income.

Almost the entire gambling business switched to a simplified taxation system, which thus significantly reduced budget allocations. Before the transition, these companies paid an average of 200,000 UAH in taxes per day, after that – up to 23,000 UAH.

Most of the benefits received by business in the first months of the war have already been canceled. On June 21, the Verkhovna Rada returned duties and taxes on the import and customs clearance of cars. In September, the government returned the excise tax on fuel. Business inspections by the tax authorities have also returned to the “normal”.
