The Council of the Krasnodar Krai Bar Chamber deprived lawyer Mikhail Benyash of legal status. Earlier, Benyash was included in the list of foreign agents by the Ministry of Justice of Russia. At the end of last year, he was accused of discrediting the Russian army due to posts on the Internet with the phrase “No war” and was fined 30 thousand rubles. Benyash acted as a defender at the trials of oppositionists and those Russians who refused to fight in Ukraine.
In 2018, Benyash was detained and, according to his words, beaten by the police. This happened on the day when he was going to appear as a defender in the case of those detained at protests against raising the retirement age. Later, the Krasnodar court found Benyash himself guilty of allegedly assaulting the police and fined him. While awaiting the verdict, Benyash spent a month in pre-trial detention center, after which he was released on bail.
Benyash was deprived of the status of a lawyer for a period of three years. The edition “Caucasian knot” notes that the meeting of the council of the chamber was held with violations: in the qualification commission there were two representatives of the Ministry of Justice of the Krasnodar region, which initiated the investigation, which violates the principle of competition and equality.
- This is not the first case of repression against Russian lawyers who express anti-war views or provide professional assistance to the opposition. After the Kremlin’s announcement of the so-called “LPR” and “DPR” joining Russia, such well-known lawyers as Vadym Klyuvgant, Konstantin Dobrynyn, and Henry Reznyk left the Federal Chamber of Advocates. The lawyers defending the opposition, Leonid Krikun, Ivan Pavlov, Yevgeny Smirnov, and Ilya Novikov, were forced to leave Russia. The former president of the Bar Association of Udmurtia, Dmitry Talantov, is in pretrial detention on charges of spreading “fakes” about the Russian army, and he may face up to 15 years in prison.
