the court confirmed the right to summon residents with armor to war

[ad_1]

The court in the Khanty-Mansiysk Autonomous Okrug ruled that military enlistment offices can conscript local residents with armor to join the war in Ukraine. The publication muksun.fm writes about this, referring to the court file.

An employee of “Surgutneftegaz”, who received armor from the company, filed a lawsuit and received a summons to mobilize for war with Ukraine. In the application, he indicated that, in addition to being retired from work, he has health problems and that he was assigned the “A” category by mistake.

It follows from the case materials that the court decided that the plaintiff was healthy, since he had not complained about his health before receiving the summons, and the reservation from the company was issued incorrectly. The judge pointed out that the plaintiff was not placed on a special account, “that is, in fact, at the time of the contested decision, there was no reservation for him.”

In the same ruling, the court concluded that military commissariats have the right to attract people with armor, because it “is not an absolute basis for granting a delay.”

Mobilized filed an appeal against the decision of the Surgut city court, but the appellate court upheld it.

  • In June, a mobilized air traffic controller from the Magadan region, Andrei Kapatsyna, was sentenced to two years and ten months in a colony-settlement for refusing to go to war in Ukraine. Airport employees were required to have a reservation from the service, but Kapatsyna was denied it.
  • On July 25, deputies of the State Duma tightened the law on military service, increased the conscription age by 3 years – from 18 to 30 years. The amendments also prohibit leaving Russia immediately after the service of the summons. Russians will be fined 30,000 rubles instead of the current 3,000 rubles for not appearing at the military enlistment office. The deputies also rejected the amendment on the postponement of mobilization for fathers of three children under the age of 18 and disabled children.
