The regulator is investigating a possible Energoatom electricity scheme with the participation of DTEK

The energy regulator has started an investigation into possible damage to the state-owned Energoatom in favor of Rinat Akhmetov’s DTEK.
This is stated in the resolution of the National Commission for Regulation of Energy and Composite Services (NKREKP), reports Interfax-Ukraine.
The regulator began an investigation into a possible violation of legislation by JSC “DTEK Zahidenergo”, JSC “DTEK Dniproenergo”, LLC “DTEK Kurakhivska TPP”, LLC “D.Trading”, JSC “EKU”, SE “NAEK “Energoatom”, LLC “Energo- gas” and LLC “Energozahid”.
Thus, the NCRECP will check the work of these companies on the day-ahead market (DAN) and the balancing market (BR) from February 1 to April 30 of this year. The NCRECP recorded possible violations in the form of restrictions on competition and/or manifestations of restrictive contractual practices in the market.
“The behavior of the specified market participants could have led to a significant decrease in the sales volume of SE NAEK Energoatom, which, as a result, became the basis for the formation of significant volumes of positive imbalance,” the justification for the resolution states. That is, before the sale of unsold by Energoatom day-ahead electricity market on the balancing market at a lower price.
In addition, the regulator notes, applications for offloading DTEK thermal power units with parallel purchase of electricity on the balancing market by traders from the same balancing group JSC “EKU” together with “Energoatom” have increased.
At the same time, “Energoatom” transferred its financial responsibility for imbalances in favor of “ECU” by joining its balancing group. According to “Ukrenergo”, in the specified period, a daily increase in the commands for balancing energy for offloading for DTEK TPP was recorded.
Instead, “Energozakhist” LLC and “Energo-Gas” LLC, as members of the EKU balancing group, delegated significant amounts of negative imbalances to the responsible party.
During the meeting of the NCRECP, the head of the department of regulatory support of “EKU” Nataliya Karabenko noted that the company did not receive any requests from the regulator for the provision of relevant information or documents that could have grounds for making such a decision.
“We believe that based on the results of the document review, there will be enough grounds to believe that this investigation could not have happened,” she said.
According to the current electricity price ceiling, the maximum marginal price on the balancing market is 120% of the day-ahead market price, the minimum price is UAH 10/MWh.
The press service of “DTEK” stated that the group complies with the requirements of the legislation, in particular in the part of regulating activities on the electricity market: “We hope for a comprehensive and impartial review by the regulator of the raised issue, taking into account the positions of the licensee companies involved in this process.
