The secret pardon of those convicted of crimes, recruited for the war with Ukraine, violates the rights of the victims. A report with an analysis of this practice was released by the Fund for the Support of Victims of Crime (FFP).
According to the fund’s experts, this practice limits the rights of victims guaranteed by the Constitution. Among other things, the opinion of the victims must be taken into account when considering the issue of pardon. However, in the case of pardoning war participants by a secret decree of the president, no one asked the opinion of the victims.
Also, the foundation notes, in 2022, Russian President Vladimir Putin repeatedly signed decrees on pardoning convicted persons with the simultaneous removal of their criminal records. According to the law, a criminal record can only be removed from someone who has already served a sentence.
“A particular alarm against this background is caused by the fact that some pardoned criminals are particularly dangerous, returning from the SVO zone (special military operation – the official Russian term for the war in Ukraine – RS), are again committing serious violent crimes, which causes a negative public resonance and leads to an increase in tension,” the report says.
In addition, the fund adds, the former convicts received a “significant preference”: the term of their participation in the war with Ukraine is limited, while the mobilized and contract soldiers fight indefinitely.
The fund calls, based on constitutional provisions, to introduce administrative supervision of pardoned convicts, implement a program for their resocialization, and create new compensation mechanisms for victims.
