On Sakhalin, Russia’s first case of voluntary surrender was opened

In the Sakhalin region, the court received the first case in Russia against a serviceman under the article of voluntary surrender. This article was introduced after the start of a full-scale invasion of Ukraine in 2022.
In addition to the charge of voluntary surrender (the article provides for up to 10 years in the colony), the soldier is charged under the article for desertion during the mobilization period (up to 15 years). Details of the case, including the name of the soldier, are not disclosed in the press service of the court.
The case became known from the database of the First Eastern District Court, which was considering an appeal against the suspect’s arrest. The Yuzhno-Sakhalin Garrison Military Court hears the case itself.
The article on voluntary surrender was introduced into the Criminal Code in September 2022, immediately after the beginning of mobilization in Russia. Together with it, punishments for a number of criminals were toughened, if they were committed during the period of mobilization or martial law.
In particular, the tightening affected the articles on the arbitrary abandonment of a unit, failure to comply with an order, and refusal to participate in military or combat operations.
The authorities also extended criminal penalties for failure to attend military training and desertion to reservists. Previously, it concerned only contract workers and conscripts.
