Public organizations submit a statement to the Federal Prosecutor’s Office of Germany regarding the commission of crimes by the Russian military. The application is filed on behalf of a Ukrainian woman who survived sexual violence during the occupation of Kyiv region. The plaintiffs Ukrainian Legal Advisory Group (ULAG) and the European Center for Constitutional and Human Rights (ECCHR) informed “UP. Life” about this. The statement says that four Russian servicemen, including two high-ranking officers, are responsible for killing the victim’s husband and committing acts of sexual violence against her. The plaintiffs point out that Ukrainian legislation does not criminalize crimes against humanity and does not provide for command responsibility. “Therefore, there is currently no opportunity to prosecute for crimes that constitute a component of a large-scale and systematic attack on the Ukrainian population – that is, crimes against humanity – in Ukraine at the moment. Senior officials cannot be held accountable in accordance with the principle of command responsibility,” the plaintiffs say. They call on the Federal Prosecutor of Germany to support the efforts of the Ukrainian authorities and start an investigation based on the principle of universal jurisdiction. As noted by Nadiya Volkova, the founder and director of ULAG, it is important that cases involving the most serious international crimes are investigated in accordance with international standards.
