In the American state of Texas, a court forbade a woman whose child was diagnosed with a fatal disease to have an abortion.
Abortions in Texas can only be performed when the pregnancy threatens the woman’s life, according to The New York Times.
The Supreme Court overturned a lower court’s permission to have an abortion on 31-year-old Kate Cox when she was 20 weeks pregnant.
The woman decided to terminate the pregnancy when she found out that her fetus had Edwards syndrome, a genetic disease that causes the child to die in the first year of life.
According to doctors, the development of the fetus and childbirth can have bad consequences for the woman herself.
In particular, there may be a rupture of the uterus and the need for a hysterectomy (removal of the uterus) and, as a result, the inability to have children in the future.
Kate Cox sought emergency abortion legal help from the Center for Reproductive Rights.
On December 7, the District Court granted the woman a temporary order allowing her to have an abortion as an exception to the law. However, Texas Attorney General Ken Paxton appealed to the state Supreme Court, demanding to block the possibility of terminating a pregnancy.
The next day, the Supreme Court suspended the abortion permit to allow more time for a final decision.
Three days later, the judge finally denied Kate the right to an abortion.
The decision was motivated by the fact that the District Court allegedly erred in ruling that she was entitled to a medical exemption.
Kate is known to have decided to leave the state to have an abortion elsewhere where it is legal.
It is noted that Kate’s case is a precedent, because in more than a year since the introduction of an almost complete ban on abortion in many Republican states of the United States, this is the first time that a woman sought permission to terminate a pregnancy.
