The appellate court issued a verdict in the case of the gang rape of a 13-year-old girl in Transcarpathia.
Three teenagers raped their girlfriend in 2021, and in March 2023, the Volovetsky District Court released the offenders from punishment, which caused outrage and caused new proceedings.
Now the Court of Appeals has returned the case to the court of first instance for retrial, the victim’s lawyers informed “UP. Life”.

“The appeals were partially satisfied and a new hearing was ordered in the court of first instance, that is, the case is returned to the district court for its consideration from the very beginning.
We appealed to fully satisfy the civil claim and to imprison the culprits. But the appeals were only partially satisfied”– say the law firm “Miller”.

The case was considered during court sessions on August 9 and 10. Initially, the court granted the requests of the prosecutors and representatives of the victim girl and began researching the audio and video recordings of the court sessions of the Volovetskyi court, in particular those sessions where the victim and the accused were interrogated.

August 10 – examined the conclusions of forensic psychiatric examinations and pre-trial reports with the characteristics of the accused.
Lawyers and prosecutors drew attention to the circumstances that led to the illegal and unfounded verdict of the Volovets court.
“The court refused to examine other evidence, which, according to the prosecutor’s office and the victim’s side, would confirm the lack of sincere remorse and recognition of guilt by the boys.
After the trial, it was decided to move on to the debate. Prosecutors and the victim’s lawyers insisted on the imposition of a real punishment and full satisfaction of the civil lawsuit.” – lawyers say.
The accused objected to the imposition of a real punishment and asked the court not to satisfy the appeals.
The full text of the decision of the appellate court will be announced on August 16 – it is not subject to appeal.
“Is this decision in favor of the victim? We understand that the consideration of the case will be delayed for some time, the victim will not receive fair compensation in the shortest possible time, there is a risk of her being questioned again in the court of first instance.
Of course, from our side, we will do everything possible to avoid an ugly interrogation of her in court, so that the trial itself took place with the minimal participation of the victim, and the adopted decision met her interests.” – commented Marta Zmysla, one of the representatives of the injured girl, lawyer “YurFem: support”.
In addition to her, the victim is represented by the lawyers of “YurFem: support” Artem Krykun-Trush and Natalia Baranova, Ilya Vorobyov from the legal company “Miller” and Roksolana Hera.
