The court acquitted the teacher of the Lviv Polytechnic National University, Dmytro Zerbino, who added pornographic images to tests for first-year students.

The decision was made by the Halytsky District Court of Lviv, reports ZAXID.NET. At the same time, the decision can still be appealed.

The man was tried under part 1 of Art. 361 of the Criminal Code (“Unauthorized interference in the operation of information and communication systems…”). In fact, he was charged with distributing malware, but was found not guilty.

Re-examination found the test program to be safe and confirmed that the program contains attention switching and “stress relief” features.

It became known about the specific method of teacher testing in 2020. He conducted a test in the program he developed himself – after each answer, the students had the opportunity to choose an image to view. In particular, there was porn.

Then Zerbino said that this is a special technique developed in Japan so that a person can learn “with pleasure”.

After the publicity, the teacher received a reprimand and criminal proceedings. He was suspended from teaching for two months, and was forbidden to teach according to the “Japanese method”.

During the trial, the teacher explained that his program really blocks students’ access to other sites and the Internet – to make it impossible to write off.

The court concluded that this very property of the program contains signs of malicious software, but is not malicious.

Zerbino also said that there were no signs of dissemination in his actions, since he used it exclusively to test the students’ knowledge.

Initially, the prosecution’s examination provided the court with evidence that Dmytro Zerbino’s program contains malicious software. Then the teacher’s lawyer presented to the court the expert’s conclusions, which refuted these data.

“The program is designed to assess knowledge by testing with the function of removing psychological stress during testing by switching attention, namely display of graphic images that the user can choose independently.

The program complies with the provided instructions for use and does not contain malicious software.” – said the conclusion.

The re-examination appointed by the court came to the same conclusion.

Students who took Zerbino’s exam said he would ask them to bring their laptops to the university, then insert his flash drive and run the test program.

There were no harmful effects on the laptops after that, and their anti-viruses did not report any threats.

In the end, the teacher was acquitted.

“Having analyzed the written documents provided by the prosecution, expert opinions, witness statements, the court comes to the conclusion that the guilt of the accused in committing the crime charged against him has not been proven by proper and admissible evidence.” – says the court decision.

Let us remind you that Dmytro Zerbino is an associate professor of the department of automated control systems of the Institute of Computer Sciences and Information Technologies of Lviv Polytechnic.

In December 2020, former university student Natalia Kindrativ complained that the teacher was showing porn to first-year students. The students themselves also filmed a conversation with the teacher about his “Japanese method”.

In the comments, some students wrote that first-year students choose porn pictures themselves. The teacher also noted that they “have the right to close their eyes or turn away from the screen.”

Dmytro Zerbino was reprimanded and returned to work after 2 months of suspension. However, the university assured that he will no longer be able to teach according to the old “methodology”.
