A woman from Lviv was sentenced to UAH 85,000 for the death of her dog, which was bitten by another dog
A resident of Lviv sued for 85,000 hryvnias from a person who looked after a dog that bit her dog. This is reported by Zaxid.net with reference to the court decision. The incident occurred on August 16, 2022, during a walk of the plaintiff’s daughter with a Labrador retriever dog named Petros. An American Akita dog ran out of the yard of the house and pounced on Petros. The plaintiff’s daughter tried to chase away someone else’s dog, pulled her own, shouted loudly and called people for help. A neighbor came out from the neighboring house and brought out hydrogen peroxide to treat Petros’s wounds. The woman also informed in which apartment the owner of the attacking dog lives. The owner’s daughter called her mother and told her what had happened. Petros’ landlady went to the apartment where the owner of the American Akita lives, and asked him how it happened that his dog was alone on the street without supervision. He said he was busy because he had an online conference for work. Meanwhile, the injured dog was taken to a veterinary clinic the next morning, where it died. According to the statement of claim, at first the owner of the American Akita admitted his guilt and agreed to reimburse all the expenses, but later he reneged on his words and even tried to intimidate the plaintiff with threats. The woman appealed to the court with a request to recover material damages from the owner of the dog. The court decided to recover more than 75,000 material damages from the husband in favor of the owner of the Labrador. This amount includes the price of the dog and the costs of its transportation and treatment. Also, the owner of the American Akita must pay the woman 10,000 hryvnias in moral damages and 4,600 hryvnias in legal fees. In a comment to Zaxid.net, the defendant’s lawyer stated that her client is not the owner of an American Akita. He looked after her while the owner was away. According to the defender, the size of the claimed claims is significantly overstated, and the plaintiff has not proven a cause-and-effect relationship between the bites inflicted by the defendant’s dog and the dog’s death. According to her, the labrador had not been vaccinated and was more than 10 years old, which could have been the cause of death. The defendant stated that he is ready to compensate the owner of the Labrador only UAH 20,000. It is worth noting that the American Akita belongs to the list of dangerous dog breeds. The weight of an adult dog can reach 60 kg, and the height at the withers – up to 70 cm. Such dogs can be used to guard homes or hunt.
