In Ukraine, control over the ban on smoking in the premises of cafes, bars, restaurants and other establishments has been restored. The State Service of Ukraine for Food Safety and Consumer Protection informed “UP. Life” about this. In Ukraine, it is illegal to smoke cigarettes, hookahs and electronic cigarettes in public places since 2012, and any devices for heating tobacco – since the summer of 2022. However, last March the government imposed a ban on anti-tobacco compliance checks. Today, the State Production and Consumer Service will once again monitor violators of smokers in cafes, bars and restaurants. However, some unscrupulous business entities took advantage of the concessions and at the cost of the health of employees and visitors in violation of the law they organized smoking (mainly hookah) in the premises of restaurants,” the State Production and Consumer Service says. It will be recalled that the Cabinet of Ministers introduced a moratorium on inspections shortly after the start of a full-scale war in March 2022. However, from July 11, 2022, the new norms of the Anti-Tobacco Law 1978-IX came into force. Now smoking cigarettes for heating in legally defined public places is prohibited along with cigarettes, hookahs and e-cigarettes (they were banned since 2012). And in April 2023, the order of the Ministry of Health entered into force, which defines the list of grounds for carrying out unscheduled measures of state supervision (control) in the field of anti-tobacco legislation. Such grounds are: independent appeal of the business entity; mandate of the Prime Minister of Ukraine and appeal of an individual. “I hope that the visitors of the establishments will respect others and observe the norms of smoke-free legislation and will not use tobacco products, hookahs, electronic cigarettes and devices for heating tobacco in prohibited places,” said Yury Sakhno, chief specialist of the Department of Control of Advertising and Compliance with Anti-Tobacco Legislation of the State Production and Consumer Service. We will remind you that earlier the NGO “Youth Free from Smoking” came to the conclusion that 80% of catering establishments in Ukraine comply with the law on the prohibition of smoking.
