Do security guards in stores have the right to check personal belongings – an explanation

If the owner, director, security guard, or salesperson wants to check your personal belongings in a supermarket or store, ask him to present documents for a search. In the absence of such documents, store employees do not have the right to search you, informs the State Production and Consumer Service. “By demanding to search the buyer’s belongings without his consent and without the involvement of the police, the security guard violates the law. In accordance with Article 29 of the Constitution of Ukraine and Article 289 of the Civil Code of Ukraine, every person has the right to freedom and personal integrity,” the department says. If the guard threatens you or does not let you out of the store, you should call the police. The security guard has the right to call the police under the following conditions: the anti-theft frame has been activated at the exit from the supermarket; surveillance cameras recorded that the buyer stole something; buyers noticed the thief and reported it to the security guard.
