In Lviv, the court reinstated a teacher who was accused of bullying

The Lviv Court of Appeal reinstated a junior school teacher who was previously accused of bullying students. The court ordered the school to pay the teacher 10,000 hryvnias in moral compensation, the court ruling says. In June 2021, the teacher of junior classes of Lviv school No. 87 was dismissed from her position due to bullying of first-graders. As Zaxid.ner reports, the parents of the students said that the teacher beat the children and also accused her of fraud with money. According to the case files, the court established that the dismissal order did not contain specific facts of disciplinary misconduct. According to the court decision of March 24, 2022, the school must pay the teacher UAH 853 for each missed working day, as well as reinstate her in her position. A few days after the court decision, the teacher handed over the court decision to the school director, but she was reinstated only on April 14, 2022. After that, the teacher applied to the court to recover 100,000 hryvnias for the moral damage caused to her and to recover the average salary for the time of the delay in the execution of the court decision. The court of first instance rejected the claim, so she filed an appeal. According to the case file, the decision to resume work from March 24, 2022 should have been implemented immediately, so the court believes that the plaintiff is entitled to compensation. At the end of June 2023, the panel of judges of the Court of Appeal partially satisfied the teacher’s claim for recovery of average salary for the time of delay in the execution of the court decision and recovery of moral damages. Therefore, the school must pay the woman 10,000 hryvnias in moral and material compensation, as well as 12,000 hryvnias due to the delay in the implementation of the decision on her reinstatement.
