In Switzerland, the court reduced the punishment for rape because it lasted 11 minutes

The Federal Court of Switzerland reduced the punishment of the rapist, because the sexual violence did not last long – for 11 minutes.

The crime happened back in 2020 in the city of Basel. The victim was raped by two men aged 33 and 17 in the entrance of her own house. Only the senior criminal was sentenced.

As early as 2021, the Basel Court of Appeal commuted the rapist’s sentence. Among the reasons was the “relatively short” duration of the act of violence – 11 minutes. The court also referred to the fact that the woman “gave ambiguous signals”, because before that she was in a bar and had voluntary unprotected sexual intercourse with another man.

The court’s decision led to protests in several cities in Switzerland. About 500 people gathered in front of the institution in Basel and held their hands up in silence for 11 minutes – how much violence poisoned.

On November 22, 2023, the Federal Court ruled that it agreed to take into account the “relatively short” duration of the rape in sentencing. However, the punishment for the criminal should be increased, because the case at the bar is not related to the crime in any way and should not affect the sentence.

The case will now be heard again by a lower court, which is expected to impose a more severe sentence.

The juvenile court acquitted the 17-year-old rapist. However, an appeal will be considered against this decision.
