In the Volovets court in Transcarpathia, the prosecution in the case of the rape of a minor filed a motion to remove the judge, that is, to remove him from the process.
This was reported to the legal company “Yurferm”.
The reason given was bias due to the permission of the representative of the Verkhovna Rada Commissioner for Human Rights to be present at closed court sessions.
The judge granted the prosecution’s request, and after a technical break, the judge’s dismissal was announced.

This procedure can be carried out if one of the parties has doubts about the impartiality of the judge, court clerk meeting, expert, specialist or translator.
“TSuch a delay in the consideration of the case, of course, does not benefit the injured girl, who will have to stay in this process longer, but the team of lawyers who represent her are ready to work to make the further process as sensitive and non-traumatizing as possible for her.”– the lawyers emphasize.
They recalled that at the previous meeting, the victim and her representatives supported changing the article from sexual violence to rape, as it was in the original indictment.
However, the prosecutor’s office supported the amended indictment under Art. 153 (sexual violence).
We will remind you that the incident happened in the summer of 2021 in Transcarpathia in the village of Verkhni Vorota. Three teenagers lured their 14-year-old girlfriend to the yard of one of the boys, and then to the basement.
One of the teenagers hit her in the stomach, and then two of the three boys raped the girl. The third one filmed it on video. With the beginning of the academic year, the video was shared on the Internet.
The girl did not tell her parents and grandmother about the rape – the latter learned about it directly from the law enforcement officers.
In court, the teenagers admitted their guilt, and the judge took into account the “calling characteristics”. So instead of 5 years of imprisonment, the judge assigned a probationary period of 2 years.
Also, the offenders had to pay the victims 60,000 hryvnias in compensation and cover procedural costs (about 25,000 hryvnias for each).
The sentence raised a wave of indignation among human rights defenders and the public.
After the publicity, ombudsman Dmytro Lubinets said that he took the case under personal control.
Journalist and activist Vitaly Glagola, who publicized the case, reported that the victim’s father agreed to file an appeal with the court, and lawyer Masi Nayem is ready to assemble a group of lawyers to defend the girl.
On September 27, the court of first instance was supposed to start a new trial of the case of the gang rape of a 14-year-old girl.
