His lawyers filed a series of appeals against the death penalty because the verdict was handed down by a judge rather than a jury. However, hours before his scheduled execution, an attempt to have his case heard by the US Supreme Court was rejected.

Now, Creech’s legal team said they are filing a new appeal, arguing that the state of Idaho, which has not carried out an execution in 12 years, is unable to carry out the procedure humanely.

Supporters of the killer claim that he has now become a different person and seek to replace his sentence with life in prison without the right to parole.
