The language ombudsman spoke about the facts of ignoring Ukrainian in the courts

In 2023, language ombudsman Taras Kremnen received complaints about court employees from Dnipropetrovsk and Khmelnytskyi regions. This was reported by the Commissioner for the Protection of the State Language. In the Dnipropetrovsk region, a court employee used a non-state language during the performance of official duties, and in the Khmelnytsky region, a court decision was drawn up in a non-Ukrainian language. “In connection with this, in 2023, the Commissioner started the implementation of two measures of state control,” says the ombudsman. Taras Kremin Taras Kremin says that the issue of compliance with the legislation on the state language in courts is under his special control. He refers to the results of the monitoring of the Unified State Register of Court Decisions conducted in 2021. At that time, the ombudsman’s secretariat recorded 49 cases of violations of the language law by courts in 12 regions of Ukraine and in the city of Kyiv. The largest number of violations were found in Kharkiv Oblast (19), Kyiv (11) and Odesa Oblast (7). Violations were also recorded in Volyn, Dnipropetrovsk, Donetsk, Zhytomyr, Kyiv, Luhansk, Mykolaiv, Kherson, Cherkasy and Chernihiv regions. “All violations concern the publication of court decisions in Russian,” says Taras Kremin. The commissioner also added that despite the occasional violations that are still recorded by citizens of Ukraine, in general, the situation with respect to the language law by judges and court employees has improved. The ombudsman reminded in which language judicial proceedings should be conducted in Ukraine: judicial proceedings are conducted in the courts of Ukraine, and paperwork is carried out in the state language; a language other than the state language may be used in court proceedings in accordance with the procedure determined by the procedural codes of Ukraine and the Law of Ukraine “On the Judicial System and the Status of Judges”; courts make decisions and publish them in the state language in accordance with the procedure established by law. The text of the court decision is compiled taking into account the standards of the state language.
