During the inspection of the Dnipro Children’s Boarding Home, in which more than 70 pupils are currently staying, unsanitary living conditions of the children were discovered. The wards of the institution were subjected to physical violence and oppression, said Dmytro Lubinets, the Commissioner for Human Rights of the Verkhovna Rada of Ukraine. Currently, there are 22 children and 53 adult wards in the boarding school. During the inspection, the employees of the monitoring group found evidence of systematic beating and physical restraint of children. In particular, one boy was lying in bed with his hands tied. It is noted that in the staff’s report notes it is said that the children allegedly “receive injuries as a result of falling from beds and self-harm during psychomotor excitement.” Photo: Ombudsman Dmytro Lubinets However, the administration did not provide confirmation regarding the examination of injured children by doctors. “Such actions of the institution’s administration and staff can be regarded as manifestations of torture, cruel or degrading treatment, treatment or punishment, in accordance with Article 3 of the Convention on the Protection of Human Rights and Fundamental Freedoms,” the ombudsman service commented on the situation. As a result of the inspection, it was noted that the pupils live in rooms that are too small and need to be repaired. Cockroaches were found in the food block of the boarding school. An unusable elevator was used to transport children with disabilities in the boarding school. Also, there is no shelter in the institution, so during the air raid the children stayed in their rooms or in the corridor. “In order to restore the violated rights of pupils and wards of the orphanage-boarding home, appropriate response letters have been sent to law enforcement agencies and the Dnipropetrovsk OVA”, Dmytro Lubinets reports. According to the woman, the Dnipro Children’s Boarding House is an institution “to which children were returned due to “bad conditions” in Poland.” “Yes, these days children with disabilities (!) are returning from Poland to Dnipro (!!) to an institution where there is not even a bomb shelter (!!!). Yes, not to the conditionally safe territories of Ukraine, they are not settled in families, under the time of active bombings… children have physical developmental disorders and cannot move independently,” Onufrik wrote on May 15. Photo: Ombudsman Dmytro Lubinets According to the results of the inspection, the Dnipro Regional Prosecutor’s Office initiated criminal proceedings. “According to the results of the monitoring of the local telegram channel, the information regarding the fact of improper performance of professional and official duties regarding the protection and health of pupils of one of the children’s boarding houses in the city of Dnipro is checked,” the prosecutor’s office notes. The sanction of article 137 of the Criminal Code on improper performance of duties regarding the protection of life and health of children of the orphanage provides for deprivation of the right to hold certain positions or engage in certain activities for a period of up to three years.
