What to do if a summons was served outside the place of residence – lawyers’ explanation

If a conscript was served with a summons at a place other than his place of residence and registration, he does not necessarily need to be registered with the Military Commissariat of another region. This was told to “Ukrainian Pravda. Life” by Andriy Novak, a lawyer at the “Miller” law firm, and Yevgenia Ryabek, a lawyer and head of the volunteer movement “Lawyers of the ZSU”. “If you are staying temporarily, transiting, on a business trip, visiting relatives, you should inform this and explain that you do not have an obligation to register in this particular region, district, city. Therefore, the requirement to appear at the new TCC does not meet the prescriptions of the legislation,” says Novak. According to the lawyer, if such a situation occurs, first of all, it is worth showing a military registration document – a military ID card, a registered, temporary certificate. What to do if the summons was served outside the place of residence? This document indicates the military commissary where the person is registered. Lawyer Yevgenia Ryabek says that if a person is issued a summons at a roadblock when he is going somewhere, it will not be a violation of the law. However, if a person goes on a business trip, he must have certain documents that prove this and indicate the terms of the business trip. Therefore, conscripts should have a full set of documents with them and present them to the person who serves the summons, and also explain that after returning home you will arrive at the military commissariat. If a summons has been issued to pass a military medical commission (MMC), the medical commission is held at the place of registration. After the medical examination, if the conscript is fit for service and has a conclusion of the VLK, he can be issued a mobilization order. However, such “summons” are definitely not served at checkpoints, the lawyer emphasizes. Read also: What threatens the Ukrainians who ignored the summons to clarify the data – lawyers
