In Japan, the demand for sterilization for sex change was recognized as unconstitutional

Japan’s Supreme Court ruled that the requirement to sterilize transgender people to change sex is unconstitutional. The resolution states that it violates the human right to happiness and is “extremely invasive.”

This decision was made after a lawsuit filed by a transgender woman. Legally, she remains a man, since she did not undergo surgery, but only underwent hormone therapy.
Before that, her claims were rejected by the Family and High Courts. Therefore, the woman decided to appeal to the Supreme Court.

According to the 2003 law, there are a number of requirements for people who wish to change sex, including the absence of reproductive glands or the irreversible loss of their reproductive function.
In addition, transgender transition requires having “a body with genitalia that resemble the genitalia of persons of the opposite sex.”
The court ruled that the mandatory removal of reproductive glands violates Article 13 of the Constitution of Japan – the human right to life, liberty and the pursuit of happiness.
The condition was also called “extremely invasive” and “too restrictive.”
“Since the law was passed (2003), medical understanding has advanced and treatments for gender dysphoria have become more diverse,” – says the resolution.
With this decision, the court overturned its previous verdict from 2019, which found the requirement to sterilize transgender people constitutional.
It is noted that since the law on people with gender dysphoria came into force in 2004, 11,919 cases of gender reassignment have been registered in Japan.
Japan is one of 18 countries that require sterilization for trans transition. The World Health Organization opposes this procedure.
