Mobilization of students and graduate students. What changes can be introduced with the new draft law

In the first reading, the Verkhovna Rada supported draft law No. 10449 on strengthening mobilization.
The draft law proposes to introduce changes regarding the norms of mobilization of students, graduate students and doctoral students.
“UP.Zhyttia” collected the main points about the changes that can be introduced regarding the mobilization of students and graduate students in the context of the new draft law.
Mobilization of students
In the text of the draft law, it is determined that the following will not be subject to conscription for military service: students of professional (vocational and technical), professional pre-higher and higher education, who study full-time or dual forms of education and obtain a level of education that is higher than the previously obtained level of education in the sequencedefined in part two of Article 10 of the Law of Ukraine “On Education”.
In fact, according to the new draft law, if a student obtains a second higher education – it doesn’t matter in what form – he will be subject to conscription for military service during mobilization.
Even if a student did not study at a college before, but entered it after obtaining a bachelor’s degree, he will not have a deferment from mobilization.
The previous law regulated this norm in a different way: currently, all those who have obtained professional (vocational-technical), professional pre-higher and higher education are not subject to conscription for military service during mobilization.
Probably, the innovation appeared against the background of the fact that the number of female and male students under the age of 20 in higher education institutions has decreased. On the other hand, the number of students aged 30-50 increased sharply.
In particular, at least 85,000 men of draft age took advantage of the opportunity to enter into a contract in the 2022/2023 academic year.
The new draft law also does not change the rules for the departure of male students abroad. They are still not released, because leaving Ukraine during martial law is prohibited for men of conscription age.

Will they mobilize graduate students?
The new draft law states that conscription for military service will be subject to mobilization graduate students who obtain a level of education at the expense of individuals or legal entities under the terms of a contract.
Such a proposal outraged the Community of postgraduate students of Ukraine. They noted that “this is a step back for the education and science of Ukraine.” According to them, the number of post-graduate students studying at state funds is only 5-10% of the entire set.
According to the data of the Ministry of Education and Science, in 2023, 2,830 state places were allocated for postgraduate studies.
And admitted to admission (to postgraduate and doctoral studies, where 311 state orders were allocated) – 19,138 people.
The Community also believes that graduate students make a great contribution to the defense of our country with their developments.
“So, for example, since 2022, the amount of research aimed at the development and creation of high-precision equipment for the Armed Forces has significantly increased, which is marked not only by high efficiency, but also by reducing the threat to our soldiers.
In addition, many scientific works relate to the development of drones, cyber defense, the creation of stronger and lighter materials for the production of armor, the provision of innovative methods and means of medical care for use on the battlefield, the improvement of encryption systems for military communications. – they emphasized.
People’s deputy Roman Hryshchuk noted that the clause on the mobilization of post-graduate students studying by contact violates the norms of the Constitution.
“IN this version of the norm violates Art. 24 of the Constitution of Ukraine, which stipulates that citizens have equal constitutional rights and freedoms and are equal before the law. In such an edition, contract graduate students are not equal to budget graduate students.” – wrote Hryshchuk.
Deputy Minister of Education and Science of Ukraine Mykhailo Vynnytskyi, in response to comments on Facebook, said that the draft law on mobilization was not coordinated with the Ministry of Education and Science.
Doctoral students and those studying for an internship are subject to deferment from mobilization.
Will university teachers be mobilized?
According to the text of the draft law, scientific and scientific-pedagogical employees of institutions of higher and professional pre-higher education, scientific institutions and organizations who have a scientific degree, are not subject to conscription during mobilization.
Teachers are also not subject to conscription, provided that this is their main place of work for at least 0.75 rates. In particular:
- scientific and scientific-pedagogical employees of institutions of professional pre-higher education, scientific institutions and organizations who have a scientific degree;
- teaching staff of institutions of professional preliminary education, professional (vocational and technical) education;
- teachers of institutions of general secondary education, but on the condition that they work, respectively, in institutions of higher or professional pre-higher education, scientific institutions and organizations, institutions of professional (vocational-technical) or general secondary education;
Amendments can be made to the draft law until February 21, after which they will vote in the second reading.
