Powers of attorney on white paper lose their validity: how can a child travel abroad accompanied by third parties?
In Ukraine, some rules for children traveling abroad accompanied by third parties by proxy have changed. These are power of attorneys issued without the use of special forms for notarial documents on white sheets of paper and certified by a notary public, the State Border Service of Ukraine reported. All notarized powers of attorney for a child to travel abroad accompanied by third parties, drawn up on white paper and issued after May 23, 2023, are invalid. Powers of attorney on white paper issued before May 23, 2023 require a certificate of confirmation. To do this, you need to contact the relevant notary with a copy of the power of attorney. The notary is obliged within 2 working days to issue a certificate confirming or refuting the certification of such a power of attorney. “PKMU No. 469 sets out changes regarding the validity of powers of attorney issued without the use of special forms of notarial documents on white sheets of paper and certified by a notary. They will be valid during martial law and within a month from the day of its termination,” said the DPSU. Changes to the rules for crossing the border are due to Cabinet Resolution No. 469, which was adopted on May 9 and entered into force on May 23. The government has made changes to some normative legal acts on the settlement of notarial acts under martial law. The most relevant in relation to the issue of crossing the state border is the rule that provides for the verification of the validity of powers of attorney, which were drawn up without the use of special forms of notarial documents on white sheets of paper and certified by a notary in accordance with the law. “If you, for example, have a similar power of attorney and plan to send your child abroad for rest and recovery accompanied by third parties, please note that the specified forms issued after May 23 are invalid,” says the DPSU. If the forms were received before May 23, the border guards may doubt their validity. When crossing the border, it is necessary to provide a certificate confirming the certification of such a power of attorney by a notary. Until you have received confirmation from a notary, border guards may refuse to cross the state border until the certificate is received. We remind you that children who have not reached the age of 16 can go abroad accompanied by one of their parents, grandparents, adult brothers, sisters, stepmothers, stepfathers or other persons authorized by one of the parents with a written statement certified by the guardianship authority. . During martial law, departure is carried out without the notarized consent of the other parent and in the presence of a passport of a citizen of Ukraine or a child’s birth certificate (in the absence of a passport)/documents containing information about the person, on the basis of which the State Border Service will allow the crossing of the state border.
