The court ordered the religious community of the Parish of Saint Nicholas (Moscow Patriarchate) to return the Nikolaev Cathedral in Kremenets to the Kremenets-Pochaiv Historical and Architectural Reserve.

On Tuesday, December 5, the Supreme Court confirmed the relevant resolution of the Western Commercial Court of Appeal from October 2, the press service of the Ministry of Culture and Information Policy reported.

Today, December 6, the first service of the Orthodox Church of Ukraine began in the morning in the Mykolaiv Cathedral. As Suspilne reports, the festive liturgy on St. Nicholas Day was led by Metropolitan Nestor of the Ternopil and Kremenets OCU. The service began with the performance of the national anthem of Ukraine.

The term of the agreement on the free use of the premises of the Mykolaiv Cathedral and other state-owned objects by the UOC MP expired at the beginning of this year – February 12, 2023.

Since then, the reserve has repeatedly notified the religious community about the expiration of the contract. The UOC MP tried to extend the validity of the contract by applying to the MKIP, but was refused.

On June 15 of this year, the Commercial Court of the Ternopil Region ordered the Parish of Saint Nicholas to return the Mykolaiv Cathedral with cells of the XVI-XVII centuries with a total area of ​​1,756.0 square meters to the Kremenets-Pochaiv Historical and Architectural Reserve.

The UOC MP filed an appeal against the court’s decision, but the appellate court upheld it.

On November 30, employees of the police and other law enforcement agencies worked on the territory of the Mykolaiv Cathedral. “Despite the court decisions, the clergy of the Ukrainian Orthodox Church refused for several months to hand over the premises of the architectural monument to the Kremenets-Pochaiv state historical and architectural reserve. In addition, on the territory of the cathedral, there was a regent’s school. Today, students and teachers were moved to pre-prepared premises, where they will be able to continue their studies“, Serhiy Zyubanenko, the head of the Main Department of the National Police of the Ternopil region, said at the time.

About Mykolaiv Cathedral

Saint Nicholas Cathedral (formerly the Franciscan monastery) – an architectural monument of national significance. It was founded in 1606 by Bishop Marcin Shyshkovsky at the wooden parish church of the Assumption of the Virgin Mary.

In the middle of the XVII century. the then Franciscan monastery was destroyed, but later resumed its activities. In the 18th century Stanislav Pototsky provided significant funds for the completion of the church.

At the beginning of the 19th century, the monastery owned the village of Bonivka (now Kremenets district), and the parish included the city of Kremenets and about 40 surrounding villages.

In 1832, by decree of Tsar Nicholas I, the Franciscan monastery was closed, and its territory and buildings were occupied by the Moscow Orthodox Church. The church was rededicated as the Mykolaiv Cathedral.
